The attorney for state Rep. Randy Terrill is being given more time to respond to a federal bankruptcy trustee’s request for more than $11,000 in funds and financial information from Terrill and his wife Angela dating back to 2004.

The filing is the latest in Terrill’s 2005 bankruptcy case.

The Terrills filed for Chapter 7 bankruptcy in October 2005; their bankruptcy was discharged in March 2006.

Earlier this summer, the case was reopened after reports published in a south Oklahoma City Hispanic newspaper alleged irregularities between Terrill’s bankruptcy petition and his state campaign filings.

In July, the case’s former trustee, attorney John D. Mashburn, said state Ethics Commission records showed Terrill had received funds from his campaign which could be considered assets.

Since then, Mashburn was reappointed as the trustee in the case. In August he filed a motion with the Western Oklahoma District Federal Bankruptcy court seeking additional funds and information from the Terrills.

Friday, Oklahoma City attorney Jeffrey West asked bankruptcy Judge T.M. Weaver for more time to comply with Mashburn’s request that Terrill pay $11,301 and turn over all financial and campaign information dating back to 2004.

Documents show a response was due from the Terrills by Saturday.

“…(the) debtor respectfully requests that your honorable court grant this application to extend time to respond to the trustee’s motion to turn over property from Sept. 6, 2008, to Sept. 12, 2008,” West wrote, “and, if needed, set this matter for a hearing and order such other and further relief as is just and proper.”

West said the Terrills “have been gathering the documentation that the trustee has requested” and have delivered that information to West.

However, West added that he has “not had sufficient time to review all of the documentation and adequately respond to the motion.”

Monday, Judge Weaver granted West’s request, allowing Terrill until Friday to file a response.

Terrill, chair of the House of Representatives’ powerful Revenue and Taxation committee, faces Moore Democrat Troy Green in the November general election.
